The government fee for trademark registration is fixed by applicant type and number of classes — but total cost varies widely once professional charges, objections, and renewal are factored in.
Trademark registration cost has two components that are easy to conflate when comparing quotes: the fixed government fee, and the professional fee charged for search, drafting, and filing — the second varies far more than the first.
Government Filing Fee
| Applicant type | Fee per class (e-filing) |
| Individual, startup (recognised), or small enterprise (MSME registered) | ₹4,500 |
| Other entities (companies not qualifying as small enterprise/startup) | ₹9,000 |
This is charged per class — if your goods/services span 2 classes, the government fee doubles. Physical (non-electronic) filing costs slightly more than the e-filing rate above.
What Counts as "Small Enterprise" for the Lower Fee
The discounted individual/startup/small-enterprise rate requires MSME (Udyam) registration or DPIIT startup recognition at the time of filing — a private limited company without either of these registrations pays the higher rate even if it's genuinely small in practice. Getting Udyam registration before filing your trademark application, if you qualify, is a straightforward way to roughly halve the government fee.
Professional Fees — the Variable Part
Professional charges for a trademark consultant or CA firm typically cover a prior trademark search (checking for conflicting existing marks before you file), drafting the application with the correct class and specification, and handling correspondence with the Trademarks Registry. These fees vary by firm and by how contested the mark's class is likely to be — a generic-sounding mark in a crowded class (like apparel or food) often needs more search and drafting care than a distinctive coined term.
Additional Costs That Can Come Up
- Objection response: If the examiner raises an objection (Section 9 — descriptiveness, or Section 11 — conflict with an existing mark), responding requires drafting and sometimes a hearing appearance. No extra government fee, but professional fees apply if you engage help.
- Opposition: If a third party opposes your published mark, contesting it involves a separate proceeding with its own government fee and professional costs — this is uncommon for genuinely distinctive marks but not rare for descriptive ones.
- Renewal: Due every 10 years, at a fee per class comparable to the original filing fee.
Why the "Cheapest Quote" Isn't Always the Cheapest Outcome
A quote that skips the prior trademark search to save on professional fees is a common way total cost balloons later — filing a mark that later gets objected to or opposed because a similar mark already exists means re-doing the search-and-strategy work after already paying the (non-refundable) government fee once. The search step is the part worth not shortcutting.
Our trademark registration service includes a prior search before filing, so class and mark-strength issues are flagged before the government fee is paid, not after an objection arrives.
Frequently Asked Questions
Does the trademark government fee change if my application gets an objection?
No additional government fee applies for responding to an examination report objection — that step is included in the original filing fee. Objections mainly add professional fees (if you engage a consultant to draft the response) and time, not a fresh government charge.
Do I have to register in every class my business might expand into later?
No — you only need to register the classes covering your current goods/services. You can always file a fresh application for additional classes later, though that means paying the government fee again for those new classes rather than it being a free add-on to an existing registration.
How much does it cost to renew a trademark?
Trademark registration is valid for 10 years and must be renewed thereafter — the renewal government fee is comparable to the original filing fee per class, and is due before expiry to avoid the mark being removed from the register (with a further condoned-delay fee if renewed after expiry but within the grace period).
